General Terms

Pornography, pirated software, mp3 archives, rom archives, freeware/shareware software archives, cracking/hacking tools, and spamming are not allowed. Any material of this nature or links to material of this nature will cause the account to be shut without financial refund. These types of sites waste bandwidth, slow down the servers and can affect the search engine ranking for your website and the sites of others. Additionally, sites of this nature often place web hosts at legal risk, and therefore cannot be allowed.

If illegal content is found in your hosting account including, but not limited to, child pornography and racial / religious hatred your details will be passed on to the police and other legal authorities to ensure prosecution. We will also pass on the details of visitors to your website and all server logs. THIS CONTENT WILL NOT BE TOLERATED!

Clients that tax a server down with malfunctioning asp scripts will lose their right to have asp scripts. Everybody writes an asp that locks up from time to time, but we will not allow one client's scripts to ruin the server speed for the rest of the clients. Keep this policy in mind when uploading asp scripts, since you assume full responsibility for every asp that you upload. If your asp is causing a noticeable performance bottleneck, your asp-script will be disabled.

When a website is found to be monopolising the resources available Digital Provision reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. Customers may be offered an option whereby Digital Provision continues hosting the website for an additional fee. Digital Provision reserves the right to refuse service and/or access to its servers to anyone.

Database Use

If you exceed the limits on our database products (MS SQL and MySQL) then we will automatically charge you for the additional space you use at our current prices. For example if you have a 150MB database and 200MB is in use at any point during a month then we will charge for the extra 150MB in that month.

Privacy Policy

Digital Provision take your privacy seriously. We will use your personal information for our business purposes and will not disclose your details to a third party. We will however disclose your information to the correct authorities if you are found in breech of our terms of service by using your webspace and or communications will illegal material.

Invoicing & Payment

We invoice for our services on a yearly basis from the date of the hosting accounts activation, and, in certain situations we will require payment before account activation. Invoices are sent out 42 days before the expiration of your services on a 28 day payment term. If payment in not received within those 28 days then a final reminder will be issued. If payment is still not made within the final reminder 14 day period then the account will be closed on the expiration date of your hosting and you will incur re-activation cost depending on what is required to reactivate your account. Please note that failure to pay in time for your domain name will result in the domain being released allowing others to purchase it.

Currently we only accept payment by bank transfer or by cheque.

Refunds

Due to the tight margins involved in domain hosting at this price, we do not offer refunds under any circumstance. However, a refund may be possible if it’s down to a clerical error or in certain extreme cases but this is decided on a case by case basis and we do not guarantee a refund.

Spam

If you send spam, your account will be closed. Even if you only send spam one time, your account will still be closed as soon as we find out you sent spam. Spam is a waste of our network and system resources, and we are completely intolerant of anybody who sends or attempts to send spam. We reserve the right to charge a penalty of £1.00 (GBP) per spam message sent (or attempted to be sent) to or through our servers. Spam penalty charges are immediately turned over to a collection agency, since we will not waste any of our time with spammers. For example, if you even attempt to send 1,000 spam emails through our servers, a collection agency will attempt to collect £1,000 (GBP) from you. The easiest way to avoid this penalty charge is to NOT send spam.

Disclaimer

Digital Provision will not be responsible for any damages your business may suffer. Digital Provision makes no warranties of any kind, expressed or implied for services we provide. Digital Provision does not back up your data/website unless it is placed on a load balanced server, and whilst every attempt would be made in the unlikely event of any corruption or hardware failure, Digital Provision cannot guarantee to be able to replace lost data. Digital Provision disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by Digital Provision and its employees. Digital Provision reserves the right to revise its policies at any time.
